The driver who struck and killed the girlfriend of Cleveland Browns defensive end Chris Smith will not face criminal charges because investigators determined she was not impaired or driving recklessly at the time, police said.
Toxicology tests showed the 47-year-old woman was not legally drunk when she struck Petara Cordero on Sept. 11 along Interstate 90 in Cleveland, police said Friday.
The woman told police officers she had been drinking prior to the crash, according to police reports.
Accident investigators also determined the woman was not speeding, police said.
Unfortunately accidents do happen.
